The deal between you and Selene.

1. Who we are

Selene is operated by Eclipse Media Pty Ltd, a company registered in Victoria, Australia. “We,” “us,” and “Selene” refer to that company. “You” means the photographer or studio with a Selene account.

2. Your account

• You must be 18 or older and able to enter a contract under Australian law.
• You are responsible for keeping your password and session cookies secure.
• You are responsible for everything that happens through your account.
• One studio per account. Multi-studio setups require enterprise terms — talk to us.

3. Your content

The photos, branding, and text you upload (“Your Content”) remain yours. By using Selene you grant us a limited license to host, process, transmit, and display Your Content for the sole purpose of operating the service — generating thumbnails, serving galleries, streaming downloads, sending invitation emails on your behalf.

We will not use Your Content to train AI models, sell it, or promote Selene without your explicit written permission. We will not access individual photos except as needed to run the service or comply with a lawful request.

4. Your clients

You are the controller of any personal data your clients provide through Selene (names, emails, favorites, comments, order notes). You agree to have a privacy policy of your own that covers this, and to honor any client request to delete their data. We act as your processor and will help you fulfill requests when asked.

5. Acceptable use

You agree not to use Selene to:

• Upload content that is illegal, infringes third-party rights, or you do not have permission to share.
• Distribute malware, run automated scrapers against the service, or attempt to break authentication.
• Send unsolicited bulk email through the share or invite features.
• Resell access to Selene to other photographers as a white-label service without an enterprise agreement.

We may suspend or terminate accounts that violate this section. We will tell you what happened and give you a chance to export your data unless legally prevented from doing so.

6. Plans and billing

• Pricing is published at selene.app/pricing. Prices are in AUD and exclude GST where applicable.
• Paid plans renew monthly or annually until cancelled. You can cancel from the dashboard at any time.
• We do not refund partial periods. If we materially change a plan’s features mid-cycle, we will refund pro-rata.
• If a payment fails we will retry, then downgrade to a read-only plan until billing is restored.

7. Trial

The 30-day free trial is one per business. We may end a trial early if we suspect abuse. You will not be charged unless you add billing details and choose to subscribe.

8. Service availability

We aim for 99.9% monthly uptime. Selene depends on third-party services — outages at Supabase, Cloudflare, or Stripe may affect us. We are not liable for downtime caused by upstream providers, but we will keep you informed and credit accounts where appropriate.

9. Storage and deletion

When you cancel, your galleries become read-only for 90 days, then are scheduled for deletion. You can export everything as ZIP at any time from the dashboard. We keep financial records as required by Australian tax law (7 years) but the photos themselves are deleted.

10. Liability

Selene is provided “as is.” To the extent permitted by law, our total liability to you for any claim arising from these terms is capped at the fees you have paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Australian Consumer Law that cannot be waived.

11. Changes

We may update these terms. For material changes we will email you 30 days before they take effect. Continued use after that date means you accept the new terms.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria unless we both agree to another forum.
